For convenience, we will refer to MyRadioCar.com as “My Radio Car,” “we,” “us,” or “our.” Like any shopping experience, transactions on My Radio Car are subject to terms and conditions. If you purchase a product from our website, these terms apply to you and My Radio Car. The Privacy Policy and Terms of Use also apply. You must be at least 18 years old to place an order on MyRadioCar.com. These general sales terms govern the contractual relationship between our company and you, the end customer, and user of the MyRadioCar.com website. By making a purchase on our site, you agree to these terms, which define the framework of sales as well as the rights and obligations that arise from it. Article 3: Order

To make a purchase, the customer may use the MyRadioCar.com website. By confirming their order through the provided link, the buyer implicitly agrees to the purchase process and the applicable general terms of sale. The information collected by the seller serves as proof of the nature, content, date, and method of payment for the purchase. This information is stored by the site. The buyer can access it by directly viewing their purchase history in their customer account on the website or by contacting customer service (available at the following address: support@myradiocar.com). Orders are only confirmed after the written confirmation from the site, which includes sending a confirmation email to the buyer, followed by the issuance of an electronic, printable invoice.

Article 4: Pricing and Billing

The prices displayed on the site are determined based on current economic conditions. No additional fees will be charged to the Buyer. The prices, including tax, are based on the rates provided by the Seller. Promotional offers presented on the website or distributed through other platforms (partners, emails, newsletters, etc.) are valid for the specified period (date and time) and are reserved for orders placed on the Site. Some offers may require the use of a promotional code, which is non-cumulative and non-refundable. To take advantage of the offer, the customer must enter the promotional code in the designated space before confirming their order. Any discount applied to an invoice, for any reason, will be deducted from our revenue, leading to a proportional reduction in the amount of VAT due. An invoice will be issued for each delivery, even in the case of partial delivery. This invoice will be accessible on the site and can be printed from the customer’s secure account (in the “My Account” section). The customer may also request a copy of the invoice by mail or email.

Article 5: Delivery and Timeframes

All purchases made on My Radio Car include personal delivery, with no minimum purchase required. This delivery is handled by a professional logistics company (La Poste, DHL, FedEx, TNT, etc.). The customer will not be charged any handling fees. Once the order is confirmed, our team will immediately begin processing it on the same day if the order is placed before noon. After that, preparations will be postponed until the next day. Please note that in some cases, My Radio Car may contact the customer by email to request additional information to properly prepare their order, especially if the delivery address is incomplete or incorrect. This may delay the shipment of the package until the customer responds and confirms the correct information.

Our typical delivery time is 5 to 10 business days, depending on the delivery address provided by the customer and the specific protocols imposed by the logistics company (disinfection, package handling, etc.). The customer will receive a tracking number from us 1 to 2 days after the order is shipped by the logistics company. MyRadioCar.com is committed to notifying the customer by email or phone if there are any delivery delays due to unforeseen circumstances. In the event of a lost package, the customer must notify us immediately by email. An investigation will be conducted with the carrier in the following days. Once the carrier confirms the loss of the order, the customer will receive a full refund of their purchase or can choose to have their order reshipped, based on their preference.

In the event of damage or non-delivery, the customer is responsible for making specific reservations on the delivery receipt in the presence of the delivery person and the logistics company’s representative. These reservations must then be confirmed (by mail or email) within 7 days of receiving the merchandise. If these reservations are not made, the seller cannot be held responsible in any way, and no compensation will be granted.

Article 6: Delivery Delay

A delivery delay may occur in the following situations:

Order Validation: To protect our customers from potential banking fraud, all our orders are thoroughly verified. We may request additional information from the Buyer before confirming the order. To prevent fraudulent use of the Buyer’s credit card or chosen payment method, we may ask for identification or proof of address via email. If these documents are not provided, the order will be canceled, and the funds charged will be automatically refunded to the customer using the same payment method used for the order.

Product Availability: Our teams strive to provide real-time information regarding product availability. However, unforeseen situations may arise despite our efforts. In such cases, MyRadioCar.com will send a message to the customer to update them on the status of their order.

Order Cancellation: If delivery is not made within 14 days of order confirmation, the order will be canceled, and the Buyer will receive a full refund for their purchase.

Article 7: Ownership Rights

All descriptions and images published on the site are protected by copyright and intellectual property rights, reserved worldwide. Therefore, it is strictly forbidden to reproduce them, even partially, without our formal consent. Additionally, the creation of hyperlinks to our site without our authorization is prohibited.

Article 8: Payment Terms and Purchase Security

Payment for an order must be made before the product is shipped. We only accept one-time payments and do not offer installment payment options. If payment is not made for an order placed on our site, the order cannot be confirmed.

For all purchases, you only pay the amount displayed on the product page, with no additional fees. Online payments on MyRadioCar.com are fully secured through a highly secure protocol (SuperCert 128-bit SSL encryption). The customer’s account will be debited on the day the order is confirmed, pending approval by the appropriate payment centers. If approval is not granted, the payment will not be processed. If the payment is declined by the payment center, we reserve the right to suspend the order. The Buyer will be informed via email and must contact their bank to validate the transaction. My Radio Car does not store your banking details at any time, as only the payment processor, Stripe, has access to them.

Article 9: Receipt, Return, and Refund

Without prejudice to the procedures to be followed with the carrier, any complaint regarding a visible defect in the product must be communicated as soon as the order is received. To return a product, the Buyer must first contact our customer service team, available 5 days a week from 8 am to 5 pm, via email at support@myradiocar.com. Customer service will provide instructions, send a return label, and supply the return address, which could be one of our warehouses in the United States, Europe, or Asia.

The Buyer must return the product in its original condition, with no modifications or damage, and with all items included in the order (accessories, manual, etc.). The product must not have been used, as prior use will render the product non-returnable. The package must be properly packed. Otherwise, our team reserves the right to refuse the product return. Once the package has been shipped, the Buyer must provide our customer service team with the tracking number so we can follow the return process. Return shipping costs will be the responsibility of the Buyer.

Once the package has been returned to one of our facilities, our refund service will send you a confirmation email. You will then be fully refunded for your purchase through the payment method used at checkout, via bank transfer, or any other method agreed upon with the customer. The refund will be processed 5 to 10 days after the product is received. Before returning the product, we encourage the customer to take clear photos of each item sent to them as proof of the product’s condition before shipping. This will allow us to verify the product’s condition, and in the event of any damage, prove that the customer is not responsible, allowing for a full refund. In the case of damage caused by the customer to the product, My Radio Car will inform the customer and assess the extent of the damage. We will then agree with the customer on the amount to be deducted, by mutual agreement, from the total refund.

Article 10: Warranties – Withdrawals – Cancellations

Products delivered by MyRadioCar.com are covered by the Seller’s warranty in accordance with the legal provisions of the Civil Code and the Consumer Code. The customer benefits from a 14-day “satisfied or refunded” guarantee and can exercise their right of withdrawal for a refund. However, they must notify our customer service team via email at support@myradiocar.com of their intention to withdraw. We will then confirm the steps to follow for returning the product (see Article 9), and a full refund will be issued once the product is returned. The customer may also choose to cancel their order under certain conditions. To cancel an order, the request must be made via email at support@myradiocar.com before the package is shipped. Once the package has been sent, My Radio Car cannot intervene to retrieve it. The Buyer must then receive the package and exercise their right of withdrawal as previously stated.

Under the legal warranty of conformity, the consumer can, in the event of a defect or other problem with the product upon receipt, choose between replacing the product or receiving a refund for the purchase. They must prove a conformity defect within the 14-day “satisfied or refunded” guarantee period following delivery by sending photos or videos according to the instructions provided by our technical support team.

Unless otherwise stated, the delivered product is covered by the Seller’s warranty in accordance with the public order rules of the Civil Code. The warranty does not cover defects or deterioration caused by wear and tear, external accidents (such as improper maintenance, impacts, etc.), or installation not in accordance with the instructions and recommendations provided by the manufacturer. Return shipping costs under the warranty will be borne by the Buyer. The shipping costs for the product replacement will be covered by the Seller for shipments within the United States and by the Buyer for shipments to other countries.

Article 11: Obligations of the Seller and Buyer

MyRadioCar.com commits to providing the Customer with a technical manual, including all necessary explanations for the installation of the purchased product, along with the delivery of said product. The Seller reserves the right, in case certain components or software are unavailable, to provide components or software with equivalent performance (in accordance with the technical manual). The Seller does not guarantee the absence of design or manufacturing defects in its products. Therefore, the customer retains their direct warranty rights with the manufacturer of the product.

The customer is responsible for determining their own needs and selecting products with full awareness. It is their duty to settle the purchase and associated fees within the given deadlines. The customer must also ensure that the product is installed in accordance with the instructions provided in the technical manual supplied by the Seller.+

Article 12: Suspension of Obligations in Case of Force Majeure

In addition to the situations typically recognized under American case law, the Seller’s obligations may be suspended in circumstances beyond their control that prevent the fulfillment of the contract’s terms, such as fire, storm, flood, etc. As soon as the Seller becomes aware of such a situation, they must inform the customer promptly to allow the agreed service to be carried out as soon as possible. Once the cause of the suspension is resolved, the Seller must notify the Buyer of the resumption of obligations.

Article 13: Disputes

In accordance with the Consumer Code, any dispute may be brought before a competent court, facilitating independent and out-of-court online dispute resolution between consumers and professionals.

The law applies solely to the relationship between the Seller and the Buyer, even if the latter is located abroad, their order is delivered from abroad, or payment is made from a country other than the United States. Both parties must seek an amicable agreement before any legal action. Any dispute related to this sale, even in the case of a warranty claim or multiple defendants, will fall under the exclusive jurisdiction of American courts.
